The KIDS’ NITE OUT ACROSS AMERICA® name and reputation were built on a foundation of trust. This Kids’ Nite Out Across America® Privacy Policy ("Policy") describes how Kids’ Nite Out Across America® and its subsidiaries and affiliated companies ("KNOAA")," “we,” or “us”) collects, uses and discloses personal information of customers through our websites and online services, including KidsNiteOut.org, and other KNOAA owned or operated websites and online services that link to this policy (collectively, the “Sites”), through our programs and at facilities and events (collectively, the "Services"). This Policy does not apply to websites and services that display or link to different privacy statements. Websites and services co-branded with other partners may display or link to a joint privacy statement or separate privacy statements of our partners in addition to our Policy.


What Type of Information Does KNOAA Collect?

Personal Information

As part of our normal business practice, we use the Services to facilitate communication with the general public, and our potential and existing customers. As part of that process, it is often necessary or desirable for us to collect personal information. Personal Information that may be collected by KNOAA includes:

  • Name, postal address, phone number, and e-mail address.
  • Information regarding your child, including their name, age, and gender.

Financial account information, such as credit card number and other payment information. 

  • If you create an account - your username, password, your city of birth, your birthday and mobile phone number.
  • If you buy goods at our locations or through our programs or otherwise - what you buy, where you buy, how frequently you buy and rewards you earn.
  • If you take a survey or interact with us in various other ways - demographic information and information about subjects that may interest you.
  • Photos, video, audio recordings, and text content, if you share these with us on our Sites or at any of our locations in our emails. We use Web beacons to deliver cookies, count visits, understand usage and campaign effectiveness and to tell if an email has been opened and acted upon. KNOAA may also collect aggregated data which we provide Services.
  • Your social media account names and handles.
  • Any information or data collected that tracks your use of or actions taken on our website through your web browser.

Your choice to submit this personal information is completely voluntary. In addition to the foregoing personal information that you voluntarily provide, we will obtain the following information from sources other than you, which we may link to the personal information you provide us: 

  • Social media network posts and other information – If you contact or engage with us through social media, such as by “liking” us, following our account, making a post on our page, tagging us, or otherwise linking your social media accounts to any of our accounts or pages, on Facebook, Twitter, or any other social media networks, we will receive and have the ability to access the information you post and information about you which you permit the social media network to share under your settings and terms with the social media network.
  • Other third parties – We may receive personal information from third parties, such as our marketing partners.
  • Other public sources – We may collect personal information that is available publicly, such as through online sources.

We may combine information we collect about you with information we receive from these other sources.

How Does KNOAA Use Information About You?
 

KNOAA may use information about you for purposes described in this Policy or disclosed to you on our Sites or with our Services. 

For example, we may use information about you to:

  • Process and manage your purchase and use of KNOAA products and Services, including your accounts and program participation.
  • Respond to your customer service inquiries, post your comments or statements on any blog or other online forum maintained on our Sites, or take other actions in response to your inquiries or other Site activities.
  • Create personalized promotions by combining your personal information with non -personal information about you, such as the amounts and types of purchases you make or any benefits you receive through our programs.
  • If you join any loyalty program or other program that involves the use of e-mail or text messaging, to send you promotional communications in accordance with the terms of those programs, track your purchases and participation in the Services, and to market to you.
  • Communicate with you about your orders or purchases, your Services, accounts and program participation, a contest or sweepstakes you have entered, and your requests for information.
  • Communicate with you about our brands, products, events or other promotional purposes, including co-branded offers and affiliate and third party offers.  In the case of promotion on behalf of third parties by us, your personal information is not transferred to the third party.
  • Verifying your authority to enter certain sections of the Sites and to log into any account you have established with us.
  • If you participate in a survey, to conduct research about your opinions on our Services and products or potential new services and products.
  • To analyze our customer base and improve, develop, monitor, and tailor product and service offerings accordingly, including compiling and analyzing statistical information.
  • For purposes of fraud control.
  • In any other situation where you approve or consent to the use.

Does KNOAA Share Personal Information with Third Parties?

  • KNOAA shares your personal information in limited ways.. We may share personal information with our affiliates who may use the information in the same manner as permitted for us under this Policy.
  • We may also share information with companies that provide support services to us (such as credit card processors, waiver services, advertising services providers, customer support services, statistical research providers, mailing houses or website hosts) and that help us market our products and services (such as email vendors). These companies may use information about you to perform their functions on our behalf. 
  • We may disclose specific information (i) upon lawful request, in response to legal process, and when required to comply with laws, (ii) to enforce our agreements, corporate policies, and terms of use or (iii) to protect the rights, property or safety of KNOAA, our employees, agents, customers, and others.• .
  • If you participate in any blog or other online forum on our Sites, or if you provide or make available any other content for the purpose of it being shared (such as a testimonial, social media post, or tag relating to any of our accounts or Sites), any personal information that you provide in such context may be shared with other Site visitors, and with customers and prospective customers of ours.  By providing any of this publicly viewed content, you are authorizing us to use that content.
  • In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of our business assets, KNOAA may disclose personal information to those involved in the negotiation or transfer. We may also share aggregated or anonymized information that does not directly identify you.


What Choices Does KNOAA Offer About Personal Information?

KNOAA offers choices for you to request to access, update, change, correct, or delete your personal information. We do not use personal information for targeted advertising and sales beyond KNOAA. To make any requests to change your personal information or how it is used, please follow the instructions found in the “How to Make Personal Information Requests” below. 

If you opt out of receiving promotional communications from us, we may still send you non-promotional communications such as emails about your accounts or our ongoing business relations. You can usually choose to set your browser to warn you when a cookie is being sent or to remove or reject cookies. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookie settings. If you choose to remove or reject cookies, it will affect many features or Services on our Sites.

  • Access My Personal Information. You may request to know whether we have collected, used, sold, stored, disclosed, analyzed, deleted, or modified any of your personal information. 
  • Correct or Delete My Personal Information. If any of the personal information that you have provided to us through our Services changes, or if you no longer desire for us to retain your personal information for the purposes set forth in this Policy, you may request the correction, update, or deletion of such information. Please be sure to provide complete account information so we can identify and authenticate your identity in our records and connect it to your personal information.

How to Make Personal Information Requests 

To make any of the above requests regarding the choices we offer about personal information, please write info@kidsniteout.org or visit our webpage at KidsNiteOut.org. Upon making a request, be prepared to provide complete and accurate account or personal information so that KNOAA may authenticate your identity. When authenticating your identity, you are not required to provide us with any additional personal information other than any personal information you have provided us through your use of our Services or account features.   

We do not have to process your requests if we cannot authenticate your identity either because you have provided incorrect or inadequate information, or because we do not have any of your personal information collected or stored in our system. Additionally, if your identity has been authenticated, we do not have to process your request if we cannot associate your request with specific personal information and we have not sold or voluntary disclosed your personal information with any third parties, other than those third parties in which you have authorized us to do so to provide Services to you.


How is Personal Information Stored and Secured?

We will store any personal information that you provide to us solely through the Services in a secure location, until such time as you request that we delete your personal information as set forth in the “What Choices Does KNOAA Offer About Personal Information?” and “How to Make Personal Information Requests” sections above or until the time we deem such personal information is no longer useful in our normal business operations. In deleting or disposing of your personal information, we will use commercially reasonable efforts to ensure the protection of your personal information. Personal information collected through the Services may be stored and processed in the United States or any other country in which we or our affiliates, subsidiaries or agents maintain facilities, and by using the Services, you consent to any such transfer of information outside of your country. KNOAA takes reasonable steps to maintain appropriate physical, technical and administrative security to help prevent and detect loss, misuse, unauthorized access, disclosure or modification of personal information. While we take these reasonable efforts to safeguard your personal information, no system or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure, and we cannot guarantee its absolute security.

Third Party Websites

The Sites and other portions of the Services may contain links to websites not controlled or operated by us, including those of other private entities and organizations. Please be aware that when you follow a link to another website, you are then subject to the privacy policy or statement of the new website. We do not take responsibility for, nor make any claim or representation as to the privacy policy or statement of any other website. We recommend that you review the privacy policy or statement of any other website before submitting personal information to the controller or operator of such website. We encourage you to review the privacy statements of websites you choose to link to from the Services so that you can understand how those websites collect, use and share your information. We are not responsible for the privacy statements or other content on such third-party websites.

Children Under 13 

We do not directly collect information from children under 13 years old. If you are under 13 years of age, you should not use the Sites or any other part of the Services for any purpose. 

E-Mail or Text Communication

By sending an electronic mail or text message to us, for example, by sending an e-mail requesting information on our Services, you may be sending us personally identifiable information. In these cases, we may retain the information as long as necessary to accurately respond to your request.

Please be aware that e-mail and text messaging are not necessarily secure from interception or misdirection. For your own protection you may want to communicate sensitive information to us using a method other than e-mail or text.

Terms of Sale
All sales from the Sites are governed by KNOAA Terms of Sale. Please refer to our Terms of Sale for the terms, conditions and policies applicable to your purchase of products from KNOAA.  By ordering products through our Sites, you agree to be bound by and accept the Terms of Sale.  The Terms of Sale are subject to change without prior notice at any time, in KNOAA' sole discretion, so you should review the Terms of Sale each time you make a purchase.

Product Sales and Availability
All products displayed on the Sites (other than KNOAA Cards) will be delivered only within the United States and, when available, in Canada. All prices for products or offers that are displayed on the Sites are quoted in U.S. Dollars and are valid and effective only in participating stores in the United States. KNOAA reserves the right without prior notice to discontinue or change specifications on products and services offered on the Sites without incurring any obligations.  Please refer to our Returns & Exchanges policy for additional information that applies to purchases made through our Sites.

KNOAA Cards
KNOAA may allow you to purchase KNOAA Cards through the Sites.  Please refer to the KNOAA Card Terms & Conditions for more information about the terms, conditions and policies that apply to your purchase and use of KNOAA Cards.

In countries where any of the KNOAA trademarks, service marks, domain names, logos, company names or indicia of origin are not registered, KNOAA claims other rights associated with unregistered trademarks, service marks, domain names, logos, trade name, company names and indicia of origin. Restrictions on Use

License to User Content
You represent and warrant that your User Content is not subject to any confidentiality obligations and that you own and control all of the rights to the User Content or otherwise have the right to grant the rights to KNOAA that you grant herein.  KNOAA claims no ownership or control over any User Content, except as otherwise provided herein, on the Sites or in a separate agreement.  However, by submitting or posting User Content on the Sites, you grant KNOAA and its designees a worldwide, perpetual, irrevocable, non-exclusive, fully-paid up and royalty free license to use, sell, reproduce, prepare derivative works, combine with other works, alter, translate, distribute copies, display, perform, publish, license or sub-license the User Content and your name and likeness in connection with such use of your User Content.  By posting User Content, you hereby release KNOAA and its agents and employees from any claims that such use, as authorized above, violates any of your rights and you understand that you will not be entitled to any compensation for any use of your User Content.

Submission of Ideas
Separate and apart from the User Content you provide, you can submit questions, comments, feedback, suggestions, ideas, plans, notes, drawings, original or creative materials or other information about KNOAA, our Sites and our products (collectively, "Ideas").  Ideas, whether posted to the Sites or provided to KNOAA by email or otherwise are entirely voluntary, non-confidential, gratuitous and non-committal.  KNOAA shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of Ideas for any purpose, commercial or otherwise, without acknowledgment or compensation to you.  Do not send us Ideas if you expect to be paid or want to continue to own or claim rights in them; your Ideas might be great, but we may have already had the same or similar idea and we do not want disputes.

You are granted a limited, non-exclusive right to create text hyperlinks to the Sites for noncommercial purposes, provided such links do not portray KNOAA in a false, misleading, derogatory or otherwise defamatory manner and provided further that the linking site does not contain any obscene, pornographic, sexually explicit or illegal material or any material that is offensive, harassing or otherwise objectionable.  This limited right may be revoked at any time.  In addition, you may not use KNOAA's logo or other proprietary graphics to link to our Sites without our express written permission.  Further, you may not use, frame or utilize framing techniques to enclose any KNOAA trademark, logo or other proprietary information, including the images found at the Sites, the content of any text or the layout/design of any page or form contained on a page on the Sites without our express written consent.  Except as noted above, you are not conveyed any right or license by implication, estoppel or otherwise in or under any patent, trademark, copyright or proprietary right of KNOAA or any third party.KNOAA makes no claim or representation regarding, and accepts no responsibility for, the quality, content, nature or reliability of embedded content, third-party websites accessible via hyperlink or websites linking to the Sites.  Such sites are not under the control of KNOAA and KNOAA is not responsible for any embedded content or the content of any linked site or any link contained in a linked site, or any review, changes or updates to such sites.  KNOAA and its users may provide these links as a convenience to you, but the inclusion of any link does not imply affiliation, endorsement or adoption by KNOAA of any site or any information contained therein.  When you visit other sites via links or embedded content, you should understand that our terms and policies no longer govern and that the terms and policies of those third party sites will now apply.  You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from our Sites.

KNOAA may provide third party content on the Sites and links to web pages and content of third parties (collectively, “Third Party Content”) as a service to those interested in this information. We do not control, endorse or adopt any Third Party Content and can make no guarantee as to its accuracy or completeness.  You acknowledge and agree that KNOAA is not responsible or liable in any manner for any Third Party Content and undertakes no responsibility to update or review such Third Party Content. Advertisements and Promotions; Third-Party Products and Services
KNOAA may display advertisements and promotions from third parties on the Sites or may otherwise provide information about or links to third-party products or services.  Your business dealings or correspondence with, or participation in promotions of, such third parties, and any terms conditions, warranties or representations associated with such dealings or promotions, are solely between you and such third party.  KNOAA is not responsible or liable for any loss or damage of any sort incurred as the result of such dealings or promotions or as the result of the presence of such non-KNOAA advertisers or third party information on the Sites.
